Hop-On 360 Video Booth ("we", "us", "our") is dedicated to protecting the privacy of our clients and their event guests. This Privacy Policy outlines how we collect, use, store, protect, and disclose personal information in accordance with the New Zealand Privacy Act 2020. This policy applies to information collected through our website (www.welly360booth.com), during the booking process, and from individuals using our 360 photo booth services.

We collect personal information necessary to provide our services. The types of information we collect include:

  • Client Information: When you book our services, we collect information from you, the client, such as:

    • Full Name

    • Contact information (email address, phone number)

    • Event details (date, venue, type of event)

    • Billing and payment information.

  • Photo Booth User Information: When individuals use our 360 photo booth at an event, we collect:

    • Video recordings, images, and GIFs of the users (which are considered personal and potentially sensitive information).

    • Contact information (email address, phone number) – to send individual links to guests to download their image, GIFs and videos.

3.How We Use Your Information

We collect and use your information for specific, legitimate purposes, as required by the Privacy Act 2020. These purposes include:

  • To Provide Our Services: To manage your booking, set up and operate the photo booth at your event, and deliver the final video/image gallery to you.

  • To Communicate With You: To respond to your enquiries, send booking confirmations, provide updates, and request feedback.

  • For Marketing and Promotion: With your explicit consent, we may use photos and videos from your event on our website and social media channels, as well as in promotional materials. Consent for this will be sought from you (the client) in our service agreement.

  • To Improve Our Services: To analyse website usage and client feedback to improve our offerings and user experience.

  • To Comply with Legal Obligations: To meet our legal and regulatory requirements in New Zealand.

4.Consent

Consent is fundamental to our operation.

  • Client Consent: As the client booking the event, your agreement to our terms of service and this privacy policy constitutes your consent for us to collect and process your personal information for the purposes outlined.

  • Guest Consent (Photo Booth Users): Use of the 360 photo booth is voluntary. By using the 360 photo booth, you consent to being filmed and to the footage being shared with the event host (our client). You are also consenting for the image/video to be used for media marketing unless you have explicitly not given consent.

  • Consent for Minors: It is the responsibility of our client (the event host) to ensure that any minors using the photo booth have consent from their parent or legal guardian.

5.Sharing and Disclosure of Information

We will not sell or rent your personal information. We will only disclose your information in the following circumstances:

  • To the Client (Event Host): All videos and images captured at an event are provided to the client who booked the service.

  • To Third-Party Service Providers: We may use third-party services for tasks such as web hosting, payment processing, and gallery delivery. These providers are granted access only to the information necessary to perform their services and are contractually bound to protect it.

  • For Marketing: With the client's consent, selected images/videos may be shared on our public social media or website.

  • By Law: If required by New Zealand law, we may disclose your information to law enforcement or other government agencies.

  • We will take reasonable steps to ensure that any third-party providers located outside New Zealand are subject to privacy laws that provide comparable safeguards to those in the Privacy Act 2020.

6.Data Storage, Security, and Retention

  • Security: We take all reasonable steps to protect your personal information from loss, unauthorised access, modification, or disclosure. This includes using secure servers, SSL encryption for our website, and secure password policies.

  • Storage: Your personal information may be stored on secure cloud-based servers.

  • Retention: We will retain your personal information only for as long as it is necessary for the purposes for which it was collected. Client booking information will be retained for administrative and tax purposes as required by law. Videos and images from events will be securely stored for a defined period (e.g., 12 months) to allow client access, after which they will be permanently deleted from our systems.

7.Your Rights: Access and Correction

Under the Privacy Act 2020, you have the right to:

  • Request access to the personal information we hold about you.

  • Request that we correct any inaccurate personal information.

If you are a guest at an event and wish to access or delete a video you appeared in, please get in touch with the event host (our client) in the first instance. To request your own data, don't hesitate to contact our Privacy Officer (details below). We will respond to your request within 20 working days.

8.Changes to This Privacy Policy

We may update this policy from time to time to reflect changes in our practices or legal obligations. The latest version will always be available on our website, with the effective date clearly stated.
